AmCham Advocacy Focus in 2011

1. Labor regulations
a. Amendments to the Labour Law aiming at cutting bureaucracy
b. Warning against expanding applicability of any social agreement beyond parties that have negotiated it (as in case of the General Collective Agreement)

2. Real estate regulations
a. Enforcement of deadlines for local authorities for finishing zoning plans as prescribed by the Law on Planning and Construction
b. Faster issuing of construction permits
c. Clear rules and predictable costs for conversion of the right to use into ownership right

3. Tax policy and earmarked revenues
a. Any amendments to the tax policy in general should be discussed in depth with the members of the private sector
b. Advocating against introduction of additional compensations and charges in the non-fiscal regulations
c. Monitoring increase in local charges

4. IPR
a. Advocate for adoption of the Optical Discs Law and its proper enforcement
b. Facilitating enforcement of IPR related legislation

5. Health care policy
a. Increasing transparency of internal rules of the Health Insurance Fund for putting medicines on the reimbursement list
b. Removing administrative barriers for market access as well as promotion of medicines and medical devices

6. Finance
a. Advocate for adoption of the Proposal Law on Capital Markets and assist in drafting by-laws that would prevent narrow interpretation of the provisions
b. Advocate for adoption of the Proposal Law on Foreign Exchange and assist in drafting by-laws specifically with regards to regulation of netting and other new competences of the Foreign Exchange Inspectorate

7. Public procurement
a. Advocating against misuse of negotiating procedure without a public tender
b. Accepting references of multinationals from other countries
c. Further guidance in writing tender requirements in terms of: general characteristics, proportional financial requirements to the value of the bid, introducing quality standards etc.
